Terms and Conditions of Sale

1. Scope

These Terms and Conditions of Sale apply to the purchase of my original artworks through my website, by email, at exhibitions and during personal visits to my studio.

2. Purchase and Conclusion of the Contract

The artworks shown on my website are presented as part of my current selection. Their display on the website does not constitute a binding offer for sale.

If you are interested in an artwork, you can contact me by email. I will then confirm the availability of the artwork, its price and the other terms of the purchase.

The purchase contract is concluded once I have expressly confirmed your purchase request.

Payment is then made in accordance with the agreed payment terms.

3. Prices and Payment

All prices are stated in Swiss francs (CHF).

The payment method is agreed individually and payment must be made before the artwork is handed over or shipped.

The artwork remains my property until full payment has been received.

4. Collection and Shipping within Switzerland

Once full payment has been received, the artwork can, by individual agreement, be handed over in person, collected from my studio or shipped within Switzerland.

For freshly painted works, the oil paint may not yet be fully dry. In such cases, collection or shipping will be arranged accordingly.

5. Returns

In Switzerland, there is generally no statutory right of withdrawal for purchases made online.

As a voluntary gesture, I offer a 14-day return period for my original artworks from the date of receipt, unless otherwise agreed in an individual case.

If you wish to return an artwork, please notify me by email within this 14-day period. The artwork must be returned in the same condition in which it was handed over or shipped.

The buyer is responsible for the cost and risk of returning the artwork. Once I have received and inspected the undamaged artwork, the purchase price already paid will be refunded.

6. Nature of the Artworks

My artworks are handmade originals. Variations in colour, brushwork, surface texture and material characteristics are part of the individual character of a hand-painted artwork and do not constitute a defect.

The colours shown on different screens or in printed materials may differ from the actual colours and appearance of the original artwork.

Any defects that already existed at the time of handover are subject to the applicable statutory provisions.

7. Damage During Shipping

Please inspect the artwork for any shipping damage as soon as reasonably possible after receiving it.

If the artwork has been damaged during shipping, please inform me without delay and, if possible, send me photographs of the packaging and the damaged artwork.

I will work with you to find an appropriate solution and, where necessary, clarify the matter with the shipping provider.

8. Ownership and Copyright

Upon purchasing an original artwork, ownership of the physical artwork transfers to the buyer.

The copyright to the artwork remains entirely with me. The purchase of an original does not include any transfer of reproduction, usage, or publication rights.

In particular, I retain the right to continue displaying and reproducing any artwork already sold. This specifically includes the creation of fine art prints and other reproductions, as well as the use of images for my website, social media, exhibitions, publications, catalogs, press relations, and other artistic or commercial purposes.

The buyer may, of course, privately own, display and resell the original artwork. The buyer may also photograph the artwork for private purposes and share photographs of it on social media, personal blogs or similar personal platforms, provided that the artwork and the artist are appropriately credited.

Any duplication, reproduction, publication, or commercial use of the artwork or its image requires my prior written consent.

9. International Sales

Sales and deliveries outside of Switzerland are available upon request.

The terms for each specific sale, in particular shipping costs, delivery conditions, as well as any import duties, customs fees, and additional costs in the country of destination, will be agreed upon individually.

Unless explicitly agreed otherwise, the buyer shall bear all import duties and fees incurred in the country of destination.

10. Liability

Statutory provisions shall apply to damages and liability matters.

To the extent permitted by law, I shall not be liable for indirect or consequential damages. Mandatory statutory liability regulations remain reserved.

11. Applicable Law

These Terms and Conditions of Sale and the purchase contracts based on them are governed by Swiss law.

For disputes with consumers, mandatory statutory jurisdiction regulations shall apply. To the extent permitted by law, the place of jurisdiction shall be at the registered seat of the artist.

12. Severability Clause

If any provision of these Terms and Conditions of Sale is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
